CLUTCH PRODUCT TERMS AND CONDITIONS

1. INTRODUCTION

1.1 These Product Terms and Conditions ("Product Terms") govern the purchase of any physical products from Clutch ApS, CVR number 42195030 ("Clutch", "we", "our"), including but not limited to Clutch cameras and related accessories (the "Products").
1.2 By purchasing Products from Clutch, you agree to be bound by these Product Terms, which form part of the Clutch General Terms and Conditions. In the event of a conflict, these Product Terms shall prevail for matters relating specifically to Products.

2. ORDERING AND PAYMENT

2.1 Orders for Products are placed via the Clutch website, app or through a Clutch sales representative.
2.2 All prices are stated exclusive of applicable taxes, customs duties, and shipping costs unless otherwise specified.
2.3 Payment must be received in full before Products are dispatched.

3. DELIVERY

3.1 Delivery times are estimates only and are not guaranteed.
3.2 Risk of loss or damage to Products passes to you upon delivery to the carrier.
3.3 You are responsible for any import duties, taxes, or other charges applied by the destination country.

4. RETURNS POLICY

4.1 You may return a Product within thirty (30) days of receipt for a refund of the purchase price, provided that:
(a) The Product is returned in new and unused condition, in its original packaging, with all accessories and documentation; and
(b) You cover all costs of return shipping, insurance, and any applicable customs fees.
4.2 Refunds will be processed within a reasonable time after Clutch confirms the returned Product meets these conditions.
4.3 Products returned in a condition that does not meet the above criteria will not be eligible for a refund and will be returned to you at your expense.

5. WARRANTY

5.1 Clutch warrants that the Product will be free from manufacturing defects in materials and workmanship under normal use for a period of twelve (12) months from the date of delivery ("Warranty Period").
5.2 This warranty does not cover:
(a) Damage caused by misuse, abuse, accident, neglect, improper installation, or modification;
(b) Normal wear and tear;
(c) Damage caused by third-party products;
(d) Software or services provided by Clutch (covered under the General Terms).
5.3 If a valid warranty claim is made during the Warranty Period, Clutch will, at its option:
(a) Repair the defective Product;
(b) Replace the defective Product with an equivalent model; or
(c) Refund the purchase price.
5.4 Repaired or replaced Products are covered for the remainder of the original Warranty Period or ninety (90) days, whichever is longer.
5.5 This warranty is your sole and exclusive remedy for Product defects.

6. LIMITATION OF LIABILITY

6.1 To the fullest extent permitted by law, Clutch shall not be liable for any indirect, incidental, or consequential damages arising from the purchase, use, or inability to use the Product.
6.2 Clutch’s total liability in relation to any Product shall not exceed the purchase price paid for that Product.

7. GOVERNING LAW AND JURISDICTION

7.1 These Product Terms are governed by Danish law.
7.2 Any dispute arising out of or in connection with these Product Terms shall be subject to the exclusive jurisdiction of the courts in Copenhagen, Denmark.
